Fire Code Enforcement Policy

It is the goal of the West Metro Fire-Rescue District to ensure a minimum level of fire and life safety code compliance throughout the cities we serve. An inspection has been completed on these premises by Fire Prevention staff and this shall serve as written notice of violation. It shall be the responsibility of the owner, occupant, or representative of said property to correct or abate these hazardous conditions.

The following time line shall be followed and adhered to in completing the code violations noted on this report:

  1. After initial inspection date, responsible party shall have 30 calendar days to comply with all violations noted on report. A follow up inspection will be completed at this time by Fire Prevention staff.

  2. If violations are not completed at the time of follow up inspection, the responsible party will be given 15 additional calendar days to comply and will also be issued a 15 day notice of violation form.

  3. If after both the initial and the follow up inspection the violations have not been abated, a written citation and/or formal complaint will be issued to said responsible party. A formal complaint involves a mandatory appearance by the responsible party before a judge.

In the case of a violation that is an immediate threat to life or property, the Fire Prevention staff has the authority to order the violation corrected immediately or in a shorter time frame than noted above.

Per Minnesota Statute 299F.011, any person may appeal an order issued to them by a code official that they feel is unfair or unjust. The appeal shall be in writing and received before the initial date of compliance. This written appeal shall be directed to the Fire Chief of West Metro Fire-Rescue District at 4251 Xylon Avenue N, New Hope, MN 55428 for review and action.

Questions or concerns about the orders you have received shall be directed to the Fire Prevention staff person who issued the notice of violation at 763.230.7000.
